The Polaris RZR is a popular off-road vehicle across the United States. Polaris aggressively markets the RZR as fun and safe for family and friends. Unfortunately, many of Polaris’s off-road vehicle models have serious design defects that have injured and killed riders.
CKO’s numerous cases against Polaris involving RZR fires include 27 injuries and 12 deaths. Each of these matters involved a Polaris RZR 900, 1000, or Turbo that suddenly burst into flames. These fires have resulted in serious burn injuries and the death of multiple people.
You can read some of their stories in this New York Times profile.
As part of CKO’s work in RZR fire cases, CKO has:
- Spent over 10,000 hours working on RZR fire cases and preparing for trial;
- Taken over 30 depositions of current and former employees of Polaris, including the deposition of Polaris’s former CEO;
- Collected over seven million pages of Polaris documents;
- Spent several million dollars on investigation and testing;
- Created a redesigned RZR without the defects in the RZR;
- Prevailed in dozens of discovery and evidentiary motions against Polaris;
- Prevailed before the Minnesota Supreme Court against Polaris in In re Polaris, Inc., 967 N.W.2d 397 (Minn. 2021), an appeal in which Polaris attempted to shield critical information under the claim of attorney-client privilege;
- Obtained a ruling allowing our clients to pursue punitive damages against Polaris; and
- Accumulated a small fleet of exemplar RZRs, engines, and parts to show the defects in the RZRs (Click here to see some of CKO’s exemplar RZRs).
Polaris Off-Road Vehicle Defects Endanger Consumers
Polaris knew as early as 2011 that some RZRs were starting on fire. Yet, it was not until our 15-year-old client died as the result of a Polaris RZR fire in 2015 that Polaris finally made a sweeping recall of the vehicles. Even this reaction took months.
Polaris has recalled hundreds of thousands of vehicles, and yet fires continue to happen. Since 2013, Polaris has done more than 10 separate RZR recalls related to the potential for fire. There have been hundreds of RZR fires, numerous acres of land burned, in excess of 30 severe injuries, and at least 13 deaths. This 2019 article from the New York Times profiled some of the victims of these tragic fires including our clients.
News Outlets have interviewed CKO attorneys about their work on RZR fires multiple times. Most recently, CKO’s Eric Olson was interviewed by Mike Headrick of KSL about the fact that Polaris RZR fires continue to happen and endanger users.
Dangerous Polaris models include:
- 2011 – Current RZR 900 (2-Seater, 4-Seater, and Trail, including “RZR S”)
- 2014 – Current RZR 1000 (2-Seater and 4-Seater, including “RZR XP” and “RZR S”)
- 2016 – Current RZR Turbo (2-Seater and 4-Seater, including “RZR XP”)
We Won’t Quit Until Polaris Does
Despite Polaris’s recalls, some Polaris RZRs are still spontaneously catching fire. Riders are suffering serious burn injuries that will affect them for the rest of their lives. Polaris has issued additional recalls of vehicles with model years through 2021. In December of 2017, the Consumer Product Safety Commission issued a statement that users of vehicles were still reporting total-loss fires caused by vehicles that had been repaired per Polaris’s recall instructions.
In April 2018, Polaris settled with the U.S. Consumer Product Safety Commission over allegations that the company failed to immediately report defective models, despite having such information. Immediately following this settlement, Polaris issued an expanded recall of the RZR XP 1000 for model years 2014-2018. Multiple people have been injured in RZR fires since these recalls.

We Understand Polaris Vehicles Inside And Out
Cutt, Kendell & Olson has quickly become a national leader in ongoing litigation involving defective Polaris vehicles. Our success is not an accident: We have done the hard work to uncover the serious problems with these vehicles and assemble a history of Polaris fires.
Since accepting our first RZR case, we have developed an extensive body of knowledge about the RZR, Ranger, and Sportsman models and why they catch fire. Our lawyers have deposed key Polaris executives and other crucial witnesses.
We brought together a team of expert engineers to investigate Polaris fires, inspect Polaris machines and conduct testing to determine what is wrong with them. We have even purchased RZRs for testing, with the goal of becoming as knowledgeable about the vehicle as Polaris's engineers.
