What Went Wrong
On Friday, Sept. 20, an American Shengja tour bus was heading into Bryce Canyon when it began to veer off the road for an unknown reason. The driver allegedly overcorrected, causing the bus to tip over.
During the rollover, 11 passengers were completely ejected and 2 were partially ejected. Four passengers were killed, 15 suffered serious injuries, and 11 were transported to surrounding hospitals with less severe ailments.
Our complaint alleges that the bus driver failed to exercise reasonable care and permitted their vehicle to overturn. Under the doctrine of respondeat superior, American Shengjia, Inc. is responsible for the negligent conduct of its driver.
The company allegedly breached its duty of care to our clients by:
- Failing to act reasonably in the hiring, training, and supervision of the bus operators at America Shengjia, Inc.
- Failing to ensure that the bus was fit for transporting passengers
- Failing to properly inspect, maintain, service or repair the vehicle
- Changing the design of the bus in a way that made it unsafe
- Violating FMCSA requirements
- Failing to enforce policies and procedures to preserve passenger safety
We believe these wrongful acts and omissions caused the injuries, harms, and losses suffered by our clients.
